Applicants for employment are eligible to sign the Local 40 Out-of-Work List when they are not employed in this jurisdiction. Each applicant for employment will be placed in the highest priority group on the availability list for which he/she qualifies. Applicants may sign the Out-of-Work List Monday through Friday, between 9:00 a.m. and 5:00p.m.
An applicant qualified to work in a special skill area or areas (i.e., welding, sound, cable splicing, or underwater) should indicate so when registering on the Out-of-Work List, and may be required to show documentation or other supporting evidence to verify any special skill area of training claimed. When a referral call for special skill(s) is requested, only those applicants indicating such special skill(s) will be called.
Dispatch will be conducted by telephone, starting at 1:00 p.m. for work scheduled for the following day, and will continue until all job calls are filled. The only exceptions to this policy will be in the case of emergency (i.e., power failure, or where there is a hazard to life, limb, property or public safety), after-hours job calls for motion picture production companies or job requests that employers must fill before normal dispatch hours. Registrants will be allowed two turndowns without penalty and be rolled completely off the book for a third turndown. Being unavailable for referral when work was offered to you shall be considered a turndown. Rejection by the employer is not a turndown.
Job referrals will be offered to applicants in order of chronological priority on the Out-of-Work List and must be personally accepted or turned down by the applicant who signed the Out-of-Work List(s).
If an applicant accepts a work referral and does not report for work or visits the job and then rejects it, or if he/she quits a job which he/she has accepted, he/she will be required to sign at the bottom of the Out-of-Work List. If an employer refused to accept an applicant, the applicant will not lose his/her place on the Out-of-Work List.
All applicants must re-sign by fax or in person within the fourth week of the month (see re-sign dates on reverse) in order to retain their position on the Out-of-Work List. If you are working during re-sign and you work a cumulative total of less than 40 Hours , you must re-sign by fax upon your lay-off in order to retain your position on the Out-of-Work List . If you work over 40 hours (with no maximum limit) you will be rolled and must re-sign in person . In person re-sign hours are 9:00 a.m. to 5:00 p.m. Fax re-signs will be accepted starting 8:30 a.m., the Monday of re-sign week until Friday 5:00 p.m. of that same week .
For example, if one or several work calls accumulate to more than 40 Hours you roll off the Out-of-Work List. At this time you will be required to sign at the bottom of the Out -of-Work List.
Any applicant who is going on vacation is required to notify Local 40 by fax no later than the day before they start vacation. On return from vacation, an applicant must re-sign the Out-of-Work List and bring verifiable proof that he or she was on vacation, (such as a copy of an airline ticket, hotel bill, gas receipts), in order to retain his/her position on the Out-of-Work List. No applicant may miss re-sign for more than one consecutive month due to vacation.
Any applicant who feels that the rules of the Local 40 Dispatch Procedures are not being carried out properly, should contact the dispatcher immediately. If, after talking with the dispatcher, the applicant is not satisfied, he/she should request to review his/her question or complaint with the Business Manager.
